Judge Says Corporation's Trademarks Illegally Used; Appeal Planned

A South St. Paul man sued by some of the country's largest corporations has been ordered to surrender Web addresses he controls that use trademarked names in an effort to spread an anti-abortion message.

William Purdy Sr. was ordered Tuesday afternoon to cease using the domain names by a temporary restraining order granted by U.S. District Judge Ann Montgomery.

Purdy had been sued by McDonald's Corp., PepsiCo Inc., Coca-Cola Co., The Washington Post Co., and the Star Tribune, all organizations that argue Purdy illegally used their trademarked names for his Web sites.

Purdy said he legally acquired the domain names and the issue is one of free speech.

The domain names include mycocacola.com, mymcdonalds.com and involve other companies, too, such as Pepsico, the Washington Post, the Star Tribune and the Minneapolis Public School system.

Montgomery ordered Purdy to immediately shut down his Web sites with the confusing names and transfer their ownership to the appropriate companies.

Montgomery also ordered Purdy not to create any more Web sites with names similar to trademarked names owned by the companies and that do not alert Internet users to nature of the Web site's content within the domain name.

Purdy, who represented himself in the case, told WMNN-Radio after Tuesday's ruling that an appeal is already written and he'll seek a stay of Montgomery's order as his appeal works its way through federal courts.

The story first publicly surfaced in early July when Minneapolis school officials decried the link involving the district's name. Purdy set up most of the sites on July 4, and an attorney for the corporations suing Purdy said that even as recently as Monday he has seen new domain name registrations by Purdy, the Star Tribune reported.
