Appeals Court Orders Local Man To Cease Using Trademarked Names In Web Address

A South St. Paul man ordered by a federal judge in Minneapolis to cease using Web addresses that use trademarked names of popular American corporations to spread his anti-abortion views received a similar ruling on appeal Tuesday.

William Purdy Sr. was ordered earlier this month to surrender the domain names by a temporary restraining order granted by U.S. District Judge Ann Montgomery in Minneapolis.

Purdy had been using domain names such as mycocacola.com and mymcdonalds.com at which Web viewers were redirected to Purdy's Web site, which spoke against abortions and included graphic pictures of aborted fetuses.

Purdy had been sued by McDonald's Corp., PepsiCo Inc., Coca-Cola Co., The Washington Post Co., and the Star Tribune among others, all organizations that argue Purdy illegally used their trademarked names for his Web sites.

Purdy, who is defending himself in the case, had a pre-written legal appeal which he filed shortly after Montgomery's ruling. But the Eighth U.S. Circuit Court of Appeals refused to block Montgomery's ruling on Tueaday.

Purdy said he legally acquired the domain names and the issue is one of free speech. He told reporters Tuesday that the appeals court ruled against him because he failed to first ask Montgomery for an emergency stay to her order.

He said he plans to do that now, and is prepared to appeal his case to the U.S. Supreme Court, if necessary.

The story first publicly surfaced in early July when Minneapolis school officials decried the link involving the district's name. Purdy set up most of the sites on July 4, and an attorney for the corporations suing Purdy said that even as recently as mid July he had seen new domain name registrations by Purdy, according to published reports.
